Those who file bankruptcy will most often file under either chapter 7 or chapter 13 of the bankruptcy code. Under both chapters, a husband and wife have the option to file a single joint case, although they are not required to do so. We will not recommend bankruptcy for a consumer when, in our opinion, another option may be more suitable to address a person's immediate debt concerns. In particular, we always evaluate if a collection defense strategy can be effective. However, we believe that debt consolidation and debt settlement firms are almost never an advisable debt strategy.
